The" respondent railroad company dismissed an employee named Humphries on the ground that he had assaulted two fellow employees. His union, the Brother*34hood of Locomotive Firemen and Enginemen, protested the discharge. The customary grievance procedures on the property were invoked, but to no avail. To .enforce its demand that Humphries be reinstated, the union threatened to call a strike. Before a strike was actually Called, the respondent submitted the dispute to the National Railroad Adjustment Board, pursuant to § 3 First (i) of the Railway Labor Act.1 The Adjustment Board sustained the…
