This was an action brought by the respondent, the wife of one Arthur Mercier, on an accident insurance policy. The part of the complaint material for the purposes of this opinion is as follows:

“That the said Arthur Mercier accidentally fell and injured his left hand, between the fingers thereof, and injured and bruised his left side, directly over the heart, from which injuries he never recovered, and died on the 29th day of January, 1899, from the direct result of said injuries, independent of all other causes, and that the receiving of said…
