Sun Ridge Development, Inc. (Sun Ridge), 1 f/k/a Century West, Inc., filed suit against the City of Cheyenne (City) in district court on September 24, 1987, alleging, inter alia, an unconstitutional taking arising from the City’s use of a building moratorium to regulate Sun Ridge’s subdivision development, Crest Ridge. 2 After a six-day bench trial, the court filed, on October 13, 1988, its “Findings of Fact and Conclusions of Law.” The court found that the moratorium was a reasonable response in light of Sun Ridge’s failure to submit design plans to address and correct…
