Plaintiff Theodore Kavowras, an employee of defendant The New York Times Company (“the Times”) and a member of defendant Newspaper and Mail Deliverers’ Union (“the Union”), appeals from the judgment of the United States District Court for the Southern District of New York (Baer, J.) dismissing his claims. The complaint alleged under § 301 of the Labor Management Relations Act, 29 U.S.C. § 185, that the Times engaged in an unfair labor practice by reassigning him to an undesirable position, in violation of its collective bargaining agreement with the Union, and that the…
