This matter is before the court on the parties’ cross-motions for summary judgment filed by plaintiff August 21,1978 and defendant August 28, 1978, and plaintiff’s unresisted motion to substitute Victor Preisser as party defendant in place of Kevin Burns, pursuant to FRCP 25(d)(1). Plaintiff’s motions granted; defendants’ denied.
