KALODNER, Circuit Judge.

In this action, the plaintiff seeks redress for injuries alleged to have been sustained while he was riding in a taxicab owned by the defendant and operated by one of its employees. The jury returned a verdict in his favor, upon which judgment was en tered, and the District Judge denied the defendant’s alternative motions for a new trial or for judgment notwithstanding the verdict. 83 F.Supp. 55.
