MEMORANDUM OPINION AND ORDER

HART, District Judge.

This case involves allegations of child sexual abuse which led to the arrest of plaintiff, John Fittanto, and to the protective custody of his two children for over a year. When the children were ordered returned to the *1408Fittantos and the charges of sexual assault dropped, the Fittantos sued various municipal agencies and individuals alleging constitutional deprivations under 42 U.S.C. § 1983 and malicious prosecution under state law.
