James S. Miller died on December 31, 1924, leaving a last will and testament dated December 7, 1900. After directing his executor to pay debts and to satisfy out of personalty any mortgages which might encumber bis real estate at the time of his decease, testator provided as follows:

“Item: I give, devise and bequeath unto my wife, Rachael Sinclair Miller, such portion and share of my real and personal estate as she might be entitled to by the Intestate Laws of the State of Pennsylvania.
