Bert M. Taylor, hereafter called the- defendant, was tried in the district court for Kearney county on an indictment containing two counts, charging him with murder in the first degree. The first count alleged that the defendant killed one Pearl Taylor, intentionally,- with deliberate and premeditated malice, by choking her to such an extent that she died of the wounds, hurts and bruises inflicted thereby.
