The subject matter of this action is somewhat related to that of the equity suit of Grobe v. Roup, in which there were two appeals to this Court, one of which was disposed of in 44 W. Va. 197, and the other in 46 W. Va. 488. In February, 1898, before the suit of Grobe v. Roup and others ended and before the date of the decision on the last appeal therein, the Pomeroy National Bank instituted this action of debt in the circuit court of Cabell county for the recovery of the amount of the certificate of deposit, issued by the Huntington National-Bank to C.
