This matter is before the court on defendant’s motion to alter or amend judgment *325(Doc. # 96). On January 29, 1997, the court entered a memorandum and order denying defendant’s motion to vacate, set aside, or correct his sentence pursuant to 28 U.S.C. § 2255. Defendant did not receive a copy of the court’s January 29 Order until April 27, 1998, after defendant inquired into the status of his motion. Defendant filed the instant motion on May 18, 1998.
