BOGGS, Circuit Judge.
Harold McQueen appeals from the district court’s denial of his petition for a writ of habeas corpus (No. 93-5854) and from the district court’s denial of his subsequent motion for relief from judgment under Fed.R.Civ.P. 60(b) (No. 94-6116). A Kentucky court convicted McQueen of capital murder and sentenced him to death in 1981.
