The question for decision is the validity of a decree rendered by a special chancellor.
Hon. Francis Cherry is, and was at all times herein involved, the regularly elected and commissioned chancellor of the 12th Chancery Circuit, of which the Chicka-sawba District of Mississippi county is a part. In 1944, Hon. Francis Cherry entered the Armed Forces of the United States.
