Respondent, by the Attorney General, has filed a motion herein requesting this Court to vacate its prior opinion filed November- 13, 1972 (reported at 486 S.W.2d 219) and to docket the case for resubmission. The motion was filed pursuant to a Memorandum and Order entered April 18, 1973, by the United States District Court for the Western District of Missouri, Western Division, in Victor A. Colbert v.
