Plaintiff, Philip Morris Incorporated (“Philip Morris”), brings this action for injunctive relief and damages for the Defendants’ alleged willful acts of trademark infringement, false designation of origin, unfair competition, and trademark dilution, arising out of the Defendants’ alleged distribution and sale within the United States of Marlboro brand cigarettes that were previously .designated for export and retail sale outside the United States (“foreign Marlboros”).
