DECISION AND ORDER
RICHARD L. SPEER, Bankruptcy Judge.
This cause is before the Court upon the Plaintiff/Trustee’s Complaint, brought in accordance with Bankruptcy Rule 7001(3), to obtain approval under § 363(h) for the sale of the interests of the estate and of co-owners in property. On this Complaint, Cross Motions for Summary Judgment were filed by the Trustee and the Debt- or/Defendant.
