Plaintiff in error was tried and- convicted upon an information, the charging part of which is as follows:

“That T. J. Crowell and John Brown did, in Wagoner county and in the state of Oklahoma, on-or about the 29th day of July, in the- year of our Lord one thousand-1 nine hundred and nine, and anterior to the presentment hereof, commit. the crime of stealing mules, .in the manner and form as. follows, to wit: That the said T.
