CARRIGAN, District Judge.

This is an action for judicial review of a decision by the United States Department of Energy (“DOE”) awarding the oil-company plaintiffs and other claimants less than the entire amount of money refunded in a consent agreement between DOE and Vickers Energy Corporation. The parties have filed cross-motions for summary judgment that have been fully briefed. Additionally, an amicus curiae brief has been filed by the state of Colorado, Texas, Kansas, Minnesota, Missouri and Oklahoma in support of DOE’s cross-motion.
