The respondent, Halverstadt, brought this action against the appellant, Estus, to recover upon an assigned account. To the complaint of the respondent, the appellant interposed a demurrer, based on the following grounds: (1) that the court has no jurisdiction of the subject-matter of the action; (2) that several causes of action have been improperly united; and (3) that the complaint does not state facts sufficient to constitute a cause of action.
