McFarland, Justice:
Barney Intogna, hereinafter referred to as defendant, was charged, tried, and found guilty by a jury of the crime of murder in the second degree, in violation of A.R.S. § 13-451 and § 13^-52. He was sentenced to serve a term of not less than ten, nor more than eleven years, in the Arizona State Prison. From the verdict and judgment of conviction, defendant brings this appeal.
