Appellant, as plaintiff, brought an action in ejectment against appellee, as defendant, to recover possession of real estate, basing her action upon ownership and right of possession. The case has once before been submitted for our determination, and is reported in 26 Colo., 197. In accordance with the views there expressed, the defendant filed an amended cross-complaint, wherein she alleged, in substance, that she was induced to enter into a contract of marriage by an oral promise on the part of the man she married to convey the premises in controversy to her, which promise he failed to…
