January 5, 1919, plaintiff in error, Walker D. Hines, as Director General of Railroads, had charge of the Texas & Pacific Railway Company’s lines of railway, and was operating the same as a carrier engaged in interstate commerce. On the morning of that day Walter Morgan, an engineer, but serving at the time as fireman on engine No. 247 attached to a passenger train engaged in interstate commerce and being operated on the main line of said railway, was killed by a collision with engine No. 794.
