By complaint and information appellant was charged with committing an aggravated assault and battery upon Mabel Venable, and that he did then and there wound and bruise Mabel Venable by running against the said Mabel Venable with his buggy and horse, and did then and there, thereby and therewith, inflict serious bodily injury upon the said Mabel Venable.
The evidence discloses that on the evening of the alleged assault appellant “got upon an uproarious and saturated drunk,” and that he and others were traveling the road between the little village of Star and Center City; that they were either…
