delivered tbe opinion of tbe court. Tbe contract between tbe defendant and tbe plaintiff’s testatrix, upon wbicb tbe present action was brought, was made, in North Carolina during tbe war. By its terms, tbe wood purchased by tbe railroad company was to be paid for in Confederate currency. Contracts thus payable, not designed in their origin to aid tbe insurrectionary government, are not invalid between tbe parties, xt was so held in tbe first case in wbicb tbe question of tbe validity of such contracts'was presented, — that of Thorington v.
