I. INTRODUCTION
Plaintiff Henry E. McKinnon, an employee of the Federal Bureau of Prisons (“BOP”), filed this action against the United States Department of Justice and then-Attorney General Alberto R. Gonzales, alleging that Defendants discriminated against him in violation of Title VII of the Civil Rights Act of 1964, 42 U.S.C. § 2000e-2, et seq. (“Title VII”).
