This is an appeal from a judgment of the Appellate Division affirming an order of the Monmouth County Court denying an application for a writ of habeas corpus.

On March 17, 1952 the defendant Harold L. Wingler was found guilty on an indictment which charged him with *165carnal abuse (N. J. S. 24:138-1), open lewdness (N. J. S. 24:115-1), and attempting to impair the morals of a child under the age of 16 (N. J. S. 24:85-5; N. J. S. 24:96-3). In accordance with N. J.
