OPINION AND ORDER

JUSTO ARENAS, United States Chief Magistrate Judge.

Plaintiff initiated this action on July 7, 2003, and a third-amended complaint was filed on May 24, 2006. (Docket No. 54.) Jurisdiction was based upon Title VII of the Civil Rights Act of 1964, 42 U.S.C. § 2000e, and 42 U.S.C. § 1983.

Plaintiff was hired as a District Adjudication Officer (GS-801-05) by the Immigration and Naturalization Service (“INS”) on March 15, 1998. (Docket No. 54, at 2, ¶¶ 9, 11.) She alleges that she was the victim of discrimination against her based on religion, sex, and reprisal or retaliation,…
