Currently pending before the Court is the Defendants’ Motion for Partial Summary Judgment Re: Erisa Preemption of Plaintiffs State Law Claims (Doc. 19). The Defendant moves for summary 3udg-ment on Plaintiffs state law claims for breach of contract (Count One) and bad faith (Count Two). Defendant maintains that good cause appears for its motion as Plaintiffs state law claims are preempted by the Employee Retirement Income Security Act of 1974 (“ERISA”).
