WATSON, Chief Justice.

In October, 1930, defendant, appellee here, entered into a contract with one Chesher for the purchase of real property, receiving immediate possession. The agreement was embodied in a written memorandum and in a promissory note, the two bearing even date and each referring to the other. The consideration of the contract, and the principal sum of the note, was $22,500, maturing in forty-five monthly installments of $500 each; the first becoming due November 1, 1930. Provision was made for the maturing of all installments for default in any, at the vendor's election.…
