On January 14, 2015, Plaintiff Congaree Riverkeeper, Inc. (“Plaintiff’) sued Defendant Carolina Water Service, Inc. (“Defendant”) for violations of the Clean Water Act (“CWA”), 33 U.S.C. §§ 1251 et seq. (2012). In Claim I, Plaintiff claims that Defendant violated its National Pollutant Discharge Elimination System (“NDPES”) permit by failing to connect its wastewater treatment plant (“WWTP”) to the regional system.
