HOBBS, District Judge.

This cause is now before the Court on the motion to dismiss, filed by defendant The Prudential Insurance Company of America (Prudential), and defendant Rubye Gillenwater Bowen’s motion to dismiss or transfer. By order of this Court dated January 19, 1983, the motions to dismiss are treated as ones for summary judgment pursuant to Rule 12 of the Federal Rules of Civil Procedure.
