OPINION

CLAY, Circuit Judge.

Respondent Jeff White, Warden, appeals the district court’s grant of a conditional writ of habeas corpus to Petitioner Gregory Rice pursuant to 28 U.S.C. § 2254. For the reasons discussed below, we AFFIRM the decision of the district court.

BACKGROUND

Petitioner Gregory Rice and his co-defendant Jerome Knight were charged with first degree murder, in violation of Michigan Compiled Laws (“M.C.L.”) § 750.316, for the murder of Knight’s former girlfriend, Yahnica Hill.
