On December 8, 1908, appellant procured a license from the Board of Commissioners of the County of Daviess to sell intoxicating liquors to be drunk as a beverage. On February 23, 1909, pursuant to an election held under the local option law (Acts 1908 [s. s.] p. 4), a majority of the legal voters voted against licensing the sale of intoxicating liquors as a beverage in that county.
