OPINION
BLACK, District Judge.
THIS MATTER comes before the Court on the defendants’ motion for summary judgment (Doc. 21, filed September 17, 2001) on the plaintiffs complaint (Doc. 1, filed June 1, 2000), wherein the plaintiff alleges that his former employer discriminated against him because of his age in violation of the Age Discrimination in Employment Act, 29 U.S.C. § 621 et seq., and in breach of the public policy of the State of New Mexico.
