Frank Berard appeals from a judgment of the United States District Court for the District of Vermont, Jerome J. Niedermeier, Magistrate, granting defendant Vermont Parole Board (the Board) summary judgment. The case was referred to the magistrate on the consent of the parties pursuant to 28 U.S.C. § 636(c)(1), and appeal from the judgment was taken directly to this court pursuant to 28 U.S.C. § 636(c)(3). On appeal, Berard argues that the procedures afforded him under the Vermont parole statute, Vt.Stat.Ann. tit. 28 §§ 501 et seq., failed to satisfy due process. Because…
