The defendant was convicted of the crime of embezzlement and appeals from the judgment of conviction. The indictment charges: “That W. V. O’Connor did, in the county 'of Grand Forks, state of North Dakota, on the 25th day of August, a. d. 1923, commit the crime of embezzlement, committed as follows, to wit:—

“That on the said 25’th day of August, a. d. 1923, the First Savings Bank was, and for a long time prior thereto had been a state savings bank association, duly organized and existing as a corporation under and by virtue of the laws of the state of North Dakota, and…
