This is an application by the petitioner, Jay Beck, for either a peremptory or alternative order of mandamus, to compel the respondents, composing the municipal civil service commission, of the city of New York, to restore him to the eligible list for appointment to the position of director (education) of men, department of correction. The facts are virtually undisputed.
