The appellant sued the appellee. A demurrer *307to the complaint was sustained, and this ruling alone is assigned as error.

The complaint alleged that on the 4th of November, 1880, the appellee executed a certain promissory note, reading as follows:

“Tippecanoe Cqunty, Ind., Nov. 4th, 1880.
“Five months after date I promise to pay to the order of myself two hundred dollars, negotiable and payable at the Nat. State Bank of Lafayette, Ind., value received, without any relief whatever from valuation or appraisement laws. The drawer and endorser severally waive presentment for payment and…
