This action was brought by M. F. Gundelfinger, city marshal and traffic officer of the city of Hanover, against the mayor and members of the city council for the alleged wrongful removal of the plaintiff from his office. Hanover is a city of the third class. The plaintiff was appointed to the office of city marshal and traffic officer by the mayor, and the appointment was approved by the city council on May 7, 1928.
