December 2, 1909. The opinion of the Court was delivered by This is an action for damages, alleged to have been sustained by the plaintiff, by reason of the defendant's dam across the Catawba River.
The complaint alleges that the plaintiff is the owner of the tract of land described in the complaint, situate on Allison's Creek which flows into the Catawba River; that the defendant maintains the dam across the river below the plaintiff's land, to the height of about thirty feet, whereby it has backed the water of Catawba River and Allison's Creek, for miles up the said river and creek, thereby…
