*1642Appeal from a judgment of the Supreme Court, Erie County (M. William Boiler, A.J.), rendered October 8, 2010. The judgment convicted defendant, upon a jury verdict, of burglary in the second degree, grand larceny in the third degree and criminal possession of stolen property in the third degree.

It is hereby ordered that the judgment so appealed from is unanimously modified on the law and as a matter of discretion in the interest of justice by reducing the sentence on the first count of the indictment to an indeterminate term of imprisonment of 16 years to life, and by reducing the conviction…
