TORRUELLA, Circuit Judge.

Defendant-appellee Julio A. Pereira (“Pereira”) pled guilty to four counts of subscribing false tax returns and twenty-one counts of using the mails for commercial bribery. At sentencing, the district court applied the Sentencing Guidelines and found Pereira’s total offense level to be sixteen. However, citing Pereira’s extraordinary responsibilities for the care of his parents, the court departed downwards to a level ten.
