The defendant is charged with driving while intoxicated, common law (Vehicle and Traffic Law § 1192 [3]); driving while intoxicated, per se (Vehicle and Traffic Law § 1192 [2]); and driving while impaired (Vehicle and Traffic Law § 1192 [1]). On December 11, 2014, the court conducted a combined Mapp / Johnson /Huntley /Dunaway /Ayala hearing. At the conclusion of the hearing the parties requested an opportunity to file memorandums of law.
