This matter comes before us pon a motion to take off a compulsory non-suit.

At the trial of the case, the plaintiff submitted evidence showing that a Leek was drawn at Harrisburg, Pa., dated Jan. 8, 1922, in the sum of $3000, ¡aring the signature of the defendant as drawer, to the order of Barr Travis Co., Inc.; endorsed by the payee and deposited to the credit of the latter on pril 24, 1922, in the Bank of the United States, against which deposit the *644depositor checked; that, upon presentment, payment on said check was refused by the defendant and the check was…
