Two petitions by the Federal Energy Commission (“FERC”) seeking affirmance *688of two of its orders assessing civil penalties have been pending before me. One petition (Case No. 13-cv-13056) seeks affirmance of a civil penalty against Lincoln Paper and Tissue Company (“Lincoln”).
