SIMON, Judge.

Plaintiff Louis H. Wissmann, a real estate broker, sued defendant German Evangelical St. Marcus Congregation of St. Louis (St. Marcus) to recover a real estate commission. St. Marcus counterclaimed for malicious prosecution. Both parties filed motions for summary judgment. Wiss-mann’s motion was granted, and necessarily, the St. Marcus motion was denied. From that order, St. Marcus appeals. Judgment is affirmed.
