*814This writ of error brings to this court the record in the two cases named above, which, by consent of all parties, were consolidated and heard together in the trial court.. There were two trials of the cases below and the last one resulted in verdicts and judgments for both defendants. The proceedings of the second trials will not be considered, as we have no record of those trials. All of the assignments of error are directed to the rulings, of the court in the first trials.
