This matter comes on for consideration upon application of the United States to set aside an order of the respondent, Honorable Willis W. Ritter, in Civil No. C 36-53, entitled Bill Iiatah-ley, et al. v. United States of America, in which the court denied petitioner’s motion that all further proceedings in that case be heard before another judge, and for an entry of a judgment on the mandate from this court. The application also seeks to prohibit the respondent from setting the principal case for retrial before himself.
