This is an action instituted by appellee against appellant in which it was alleged that appellant and appellee were partners and that appellee had been excluded from participation in the management of the partnership property and in the profits arising therefrom, and prayed for an accounting and the appointment of a receiver to take charge of the partnership property. The petition was verified by affidavit and was met by a sworn denial of tire partnership and other defensive matter on the part of appellant.
