On the 28th day of November, 1899, H. D. Ronk, the defendant in error, filed his declaration in ejectment in the circuit court of Lincoln County, against A. E. Higginbotham and Newton Carrier, defendants below and plaintiffs in error, alleging that plaintiff, on the 15th day of January, 1899, “was possessed of an estate in fee absolute of a certain tract or parcel of land, lying and being in the said county of Lincoln, containing two hundred and ninety-four acres, more or less,” and bounded as follows: “Situate on Island Creek, a tributary of Coal River, beginning at a stake in…
